GENERAL CONDITIONS OF ONLINE SALE

1. Object

These General Conditions of Sale ("General Conditions") govern the sale of products carried out online via the electronic commerce service on the Website www.jewelsforpalnet.com to consumers of Products ("Customer"), governed in particular by Legislative Decree no. 206/2005 ("Consumer Code") and Legislative Decree no. 70/2003.

The e-commerce service is offered by Metajewels srl with headquarters in Vicenza (VI) via Vecchia Ferriera 70 at Voice of Gold, registered in the Vicenza business register, registration number, VAT number and tax code 04429850243.

Metajewels srl does not deliver the Products to countries other than those indicated. Not all Products may be available for purchase in the country of the visitor to the Site. The acceptance of the conditions by the customer is essential for completing the purchase procedure of the Products.

2. General Conditions

2.1 The General Conditions applicable to the sale of Products on the Site are those published on the Site in the section “General Conditions” on the date of sending the Purchase Order by the Registered Customer. By placing an order in the various ways provided, the Customer declares that he has read all the information provided to him during the purchase procedure, and that he fully accepts the general and payment conditions transcribed below.

2.2 Once the online purchase procedure has been completed, the Customer will print or save an electronic copy and in any case keep these general conditions of sale, in compliance with the provisions of the Consumer Code (Legislative Decree 206/05) on distance selling.

2.3 These General Conditions may be modified at any time. The version of the General Conditions published at the time of conclusion of the Contract will be binding between the Parties. Metajewels srl may in no case be held bound by conditions sent by the Customer or in any case different from these. Prices, Products on the Site and their characteristics are subject to change without notice.

2.4 These General Conditions do not regulate the sale of products and/or the provision of services by parties other than Metajewels srl or Jewels for planet that are present on the Site via links, banners or other hypertext links. Before carrying out commercial transactions with such parties, the Customer must verify their conditions of sale. Metajewels is not responsible in any way for the provision of services and/or the sale of products by such parties. Metajewels does not carry out any checks and/or monitoring on the websites that can be consulted via such links. Metajewels is therefore not responsible for the contents of such sites nor for any errors and/or omissions and/or violations of the law by the same.

3. Registration on the Site

3.1 To make a purchase, the Customer must register on the Website www.jewelsforplanet.com, access the reserved area with his/her Credentials, indicating an email address and a password to carry out the login , after having read the Information on the processing of personal data. The Customer chooses the Product to purchase and inserts it in the appropriate section of the Site "Cart", where the characteristics of the Products, the price, the applicable VAT, the shipping costs will be displayed.

3.2 The registration credentials, which can be modified by the Registered Customer at any time by accessing their Jewels for Planet Account , are personal and cannot be transferred to third parties. Registration on the Site is free.

3.2. The Customer must complete, even at a later time after registration but in any case at least before sending his first Purchase Order on the Site, the registration procedure on the Site, by accessing his Jewels for Planet Account and providing the information and personal data requested.

3.3 The Registered Customer guarantees that the information provided during the registration procedure on the Site is complete, correct and truthful. The user agrees to hold Metajewels srl harmless from any compensation obligation, sanction deriving from and/or in any way connected to the violation by the Registered Customer of the rules on registration on the Site. All operations carried out using the registration credentials are considered to have been carried out by the Registered Customer to whom the registration credentials refer.

3.4 By sending the order, the Customer expressly consents to the use by Metajewels srl of the email, telephone and address in relation to the conclusion and execution of the contract.

3.5 The Registered Customer can view the Purchase Orders placed in his/her Jewels for Planet Account, as well as manage and save personal data.

3.6 By registering on the Site, the Registered Customer may agree to receive, through the contacts provided by him/her, any invitations to participate in sales and commercial proposals from Jewels for Planet. At any time, by clicking on the appropriate link at the bottom of the invitation, the Registered Customer may request not to receive further invitations to participate in sales.

3.7 The registered Customer may cancel his/her registration to the Site at any time by sending an email to the addresses info@metajewels.it

4. Purchase procedure and conclusion of the Contract

4.1 The Customer may access the Site and view the Products for sale on the Site, learn about the characteristics and price of the Products (expressed in Euros and inclusive of VAT), shipping and delivery costs; the Customer may also view photographs of the Products, published for the sole purpose of illustrating the Products themselves.

4.2 Metajewels srl will send the Customer an order confirmation email, containing the conditions of sale and the order placed. The Customer's order and the order confirmation with the applicable General Conditions are archived electronically.

4.3 The sales contract for the Product is deemed to be concluded when Metajewels srl receives payment of the price from the Customer.

4.4 The validity of the contract is subject to the availability of the Product. In the event that the Product is no longer available, Metajewels srl will communicate this to the Customer within 20 days of receiving the Order and reserves the right to terminate the sales contract, refunding the Customer the entire price paid, without any further charge or burden of any kind to Metajewels srl .

4.5 The Customer must verify with the utmost attention and care the correctness of the data contained in the Order Confirmation and communicate any corrections to Metajewels srl within 24 (twenty-four) hours of receiving the same.

4.6. The Purchase Order contains an order number to be referred to for any communication relating to the Purchase Order itself.

4.7. Where the Customer is in possession of a Discount Code, he/she can obtain a discount on the price of the Product as indicated on the Site; the discount is limited to the price of the Product and does not apply, vice versa, to shipping costs. The Discount Code can be received by the Customer through the contacts provided by the Customer pursuant to this Contract in the context of promotional and advertising campaigns carried out by Jewels for planet or other methods specified by Jewels for planet through the Site (for example, subscription to the newsletter ). The communication with which the Registered Customer receives the Discount Code indicates, from time to time, whether i) the Discount Code has an expiry date beyond which it can no longer be used and ii) whether the Discount Code gives the right to a fixed or percentage discount.

4.8 Where the customer requests a customized product not available on the website, Metajewels srl will communicate to the customer the production and shipping time depending on the product. Metajewels srl will not be held responsible for any delays due to raw materials supplied by third parties.

5. Payment Methods

5.1 To pay the price of the Products and the related shipping and delivery costs, you can follow one of the methods indicated on the Website www.jewelsforplanet.com and which are summarised below:

• advance bank transfer of the entire price of the Product,

  Therefore, within and no later than 5 (five) days from receipt of the Acceptance, the bank transfer must be made by the Registered Customer in favour of Metajewels srl. to the following bank details:

• charge of the entire price of the Product to a credit card belonging to the circuits indicated on the Site or by charging to their Paypal account, the Customer will be redirected to the site of the institution responsible for managing the payment procedures where they will have to enter the credentials of the credit card or Paypal account, as well as any other data requested, authorizing the institution to charge the amount of the Purchase Order to said credit card or to their Paypal account. Conversely, if the Order is not accepted, no amount will be charged to the card indicated by the Registered Customer. In no case will Metajewels srl be able to access the credit card data or other data provided during payment. Metajewels srl cannot be held responsible in any way for the illicit or fraudulent use that may be made by third parties of the Customer's credit card.

6. Delivery of Products

6.1 Metajewels srl uses the shipping company Ferrari, DHL Express, Gls, TNT or the different shipping company chosen from time to time by Metajewels srl, at its sole discretion, which takes care of the deliveries of the Products purchased on the Site.

6.1.1 Delivery by forwarding agent.

Deliveries are made by the Forwarder to the postal address indicated by the Customer Registered in the Purchase Order. Deliveries will be made from Monday to Friday, during normal office hours, excluding national holidays.

6.1.2 Delivery is considered completed when the Product is made available to the Registered Customer at the address specified in the Purchase Order. In the event that the packaging shows obvious signs of tampering or alteration, the Registered Customer must report it at the time of delivery by signing the appropriate document proposed by the Shipping Agent. In the event of failure to report as indicated above, the Registered Customer will not be able to oppose to Metajewels srl any defect in the delivered Product or the lack of the same inside the packaging.

6.1.3 In the event of failed delivery due to the recipient's absence at the specified address, the Forwarder will retry delivery within the following 7 (seven) working days. If even the second delivery attempt is not successful, the Product will be returned to Metajewels srl, following a period of storage at the Forwarder (5 days for Products purchased with cash on delivery, 15 days for all other Products).

6.1.4 The following applies to all Purchase Orders. In the event that, following 2 (two) failed delivery attempts, the Product is returned by the Forwarder to Metajewels srl , the latter will inform the Customer by email of the delivery attempts made and of the fact that the Product has been returned to it by the Forwarder and (ii) of the place where the Product can be collected by the Customer in the following thirty days, unless the latter requests a new shipment at his/her expense.
After thirty days from the date on which the Product was returned to Metajewels srl and the Customer has not collected the Product or requested a new shipment, the Contract will be considered terminated and the Purchase Order cancelled pursuant to art. 1456 of the Civil Code. In this event, Metajewels srl will proceed to refund the amount paid by the Registered Customer, net of the costs of the unsuccessful delivery of the product, as well as the costs of returning the same to Metajewels srl and the storage costs, hereinafter set at a flat rate of Euro 15.

6.1.5 In the event of impediments to delivery, Metajewels srl will contact the user via email to inform them of the delay in delivery times. Metajewels cannot be held responsible in any way for any delays due to acts of third parties and/or causes of force majeure.

7. Legal guarantee and liability

7.1 All Products sold on the Site are covered by the Legal Guarantee of Conformity provided for by articles 128-135 of the Consumer Code (Legal Guarantee).

If you purchase as a "consumer", you benefit from the legal guarantee of conformity that the seller is required by law to provide on each good sold ("Legal Guarantee").

The Legal Guarantee - guarantees the goods against defects of conformity with respect to the sales contract.

7.2 The Customer is required to report the lack of conformity to Metajewels srl by registered letter with return receipt within the peremptory term of two months from the date of discovery of the defect. Metajewels srl is responsible when the lack of conformity occurs within the term of two years from delivery.

7.3. The legal guarantee of conformity applies only to defects not resulting from normal use of the Product. Products that have been repaired, modified or altered in any way are excluded from the legal guarantee. Any faults or malfunctions or defects of any other kind caused by accidental events or by the responsibility of the Registered Customer or by use of the Product that is not in accordance with its intended use and/or as provided in the technical documentation attached to the Product, where applicable, or in the instructions for use relating to the same, are also excluded from the scope of the legal guarantee.

In no event shall Metajewels srl be held liable for failure to fulfill any of its obligations under the Contracts subject to these General Conditions in the event that the failure to fulfill is caused by unforeseeable circumstances and/or force majeure, including, by way of example only, natural disasters, terrorist acts, network malfunctions and/or blackouts.

In any case, Metajewels srl 's liability may not exceed the total value of the Purchase Order.

8. Withdrawal

8.1.
Pursuant to articles 52 et seq. of the Consumer Code, the Customer who qualifies as a “consumer” pursuant to the Consumer Code has the right to withdraw from the Contract at his discretion, without any penalty and without specifying the reason, within 14 (fourteen) days from the day of delivery of the Products. The delivery note of the Shipping Agent or the delivery document of the Order constitutes full proof of receipt.

8.2 In relation to the Products delivered by a Forwarder pursuant to the previous article 6.(i), the withdrawal may be exercised using, at your choice, one of the following methods:

• by giving notice of withdrawal by registered letter with acknowledgement of receipt sent to Metajewels srl, at the following address:

The communication must include a copy of the withdrawal form, downloadable at this link and duly completed. The withdrawal may also be anticipated by email to the email address info@metajewels.it provided that the withdrawal communication is confirmed by registered letter with acknowledgement of receipt within the following 48 hours
• if you have a certified email account (PEC), simply write to info@pec.metajewels.it. The communication must include a copy of the withdrawal form, downloadable at this link and duly completed.

As required by current legislation, emails sent from a PEC account have the value of registered mail.

8.3 After sending the withdrawal notice pursuant to art. 8.4 above, the Registered Customer must send, using a carrier of his/her choice and at his/her own expense, within 14 (fourteen) days from the date of notification of withdrawal, the purchased Product to the following address: Metajewels srl c/o Ferrari Group Spa sede Malpensa, Via Natale Palli 12 21019 Case Nuove (VA).

The costs and risks associated with returning the Product are borne by the Registered Customer.

The Products must be returned intact and appropriately packaged, in their original packaging, complete with all accessories and the delivery note.

8.5 If the registered Customer exercises the right of withdrawal in accordance with this article and in compliance with the provisions of articles 52 et seq. of the Consumer Code, Metajewels, within 14 (fourteen) days of receiving the communication referred to in art. 10.1. and in any case after the return of the Product or only after having verified that the Registered Customer has sent back the Product, will reimburse the Registered Customer for the sums paid for the purchase of the Products including the shipping costs incurred for sending the Products themselves by bank transfer made to the bank details indicated by the Registered Customer on the withdrawal form.

8.6 The right of withdrawal referred to in this art. 10 is not guaranteed to Registered Customers who are not consumers pursuant to the Consumer Code and who are therefore natural or legal persons acting in the exercise of their entrepreneurial, commercial, artisanal or professional activity or an intermediary of the same.

8.7 The right of withdrawal referred to in this art. 10 cannot be exercised where the subject of the Purchase Order is a Customised Product, pursuant to art. 59, paragraph 1, letter c), Consumer Code.

9. Content

9.1. The Content of the Site is protected by copyright and all other intellectual property rights of Metajewels srl and other rights holders. Reproduction, modification, duplication, copying, distribution, sale or any other exploitation of the Content of the Site is prohibited unless previously authorized in writing by Metajewels srl or the rights holders. Any use of the contents of the Site for commercial and/or advertising purposes is also prohibited.

9.2. All other trademarks, distinctive signs, images, models that distinguish the Products sold on the Site or in any case connected to them, registered by the respective owners or in any case subject to exclusive rights by third parties, are used by Metajewels for the sole purpose of distinguishing and describing the Products for sale on the Site.

Any use of the trademarks, distinctive signs, images and models mentioned above by the user of the Site or by anyone else that is not in compliance with the law is prohibited.

9.3. Under no circumstances may the user alter, change, modify or adapt the Site, nor its Content.

10. Protection of personal data

10.1. Metajewels srl is the owner of the personal data collected at the time of registration on the Site, as well as those subsequently communicated at the time of sending the Purchase Order by the Registered Customer.
For information relating to the processing of personal data, including the rights pursuant to articles 15-16-17-18-20 of EU Reg. 2016/679, please refer to the detailed privacy information ( Privacy Policy ) available on the Site and accepted by the Registered Customer at the time of registration on the Site.
